Emily Collins focuses her practice on antitrust, complex commercial litigation, arbitration, class action and business disputes.

Emily's practice includes representing clients in various industries, from technology companies to real estate, financial services, insurance, and consumer goods.

Her antitrust experience includes representing clients in federal and state courts involving allegations of violations of Sections 1 and 2 of the Sherman Act and state antitrust consumer protection laws, monopolization, price fixing, bid rigging, exclusionary conduct, and other restraints of trade, as well as class action. Emily also counsels clients for Department of Justice and Federal Trade Commission investigations, mergers and acquisitions, employee training, and the use of artificial intelligence (AI) and algorithmic software.

Class Action
  • Defeated class certification in nationwide class action for nonpayment of bonuses in the District of Columbia for nation's largest natural and organic grocery store chain
  • Secured dismissal at summary judgment for nation's largest natural and organic grocery store chain in improper labeling nationwide class action in the Southern District of New York
  • Represented a financial institution in class action matters alleging fraud and other claims in relation to an alleged Ponzi scheme
Antitrust
  • Represents a multifamily rental housing property manager in multidistrict litigation (MDL) comprised of putative nationwide class action antitrust cases pending in several states involving the use of algorithmic pricing software and allegations of inflated rental prices
  • Regularly counsels companies regarding the use of AI and other algorithmic software to limit antitrust risks that may arise in retail, real estate, software, and manufacturing industries
  • Obtained dismissal prior to discovery of Robinson-Patman Act, business disparagement, and tortious interference claims brought by competitor of appliance repair company in Western District of Texas
  • Counselled and represented clients regarding evaluation of unfair competition and business disparagement claims
  • Represented the Texas subsidiary of a multi-state payor in case alleging an illegal boycott under the Sherman Act against plaintiff providing home treatment options in the allergy testing and treatment market in Texas
  • Counselled and represented clients regarding Hart-Scott-Rodino filings and related second requests before the US Department of Justice and Federal Trade Commissions
Financial Services Litigation
  • Represented a financial institution in litigation involving claims related to the deposit and payment of fraudulently endorsed checks in both state court and arbitration
  • Represented leading national financial institutions in matters involving checks, wires, and automated clearing house (ACH) transactions in Electronic Funds Transfer Act, Telephone Consumer Protection Act matters, and Fair Credit Reporting Act matters
Commercial
  • Represented a retailer in a real estate dispute with a joint venture partner over distribution of proceeds from the sale of land to the US government. The matter involved both state court litigation and American Arbitration Association (AAA) arbitration
